Terms of Use

1. Introduction

   This is a legal and binding agreement between you (“ User”) and Secure Blink Tech Private Limited (“ We/Us/Our/Secure Blink ”) stating the terms that govern your use of the Platform, as defined under Our Privacy Policy ( “Terms of Use ”).

   3. We shall not be liable in any way for any issues faced by the User in pursuance of clicking on such External Links on the Platform (website).

4. Access, permissions, and restrictions

      The User shall have permission to access all the information related to the Platform (website), available in the public domain, without any restrictions, apart from any such restrictions defined in the Privacy Policy/Terms of Use.

   To the fullest extent permitted by law, in no event shall Secure Blink, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, losses or expenses or consequential damages whatsoever resulting from any (i) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of Our Platform, (ii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iii) any interruption or cessation of transmission to or from the Platform, (iv) any bugs, cyber-attack, or the like, which may be transmitted to or through Our Platform by any third party, and/or (v) any errors or omissions in any User content or any other content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via Our Platform, whether based on warranty, contract, tort, or any other legal theory, and whether or not Secure Blink is advised of the possibility of such damages

   We understand, under certain jurisdictions, warranties, disclaimers and conditions may apply that cannot be legally excluded, if that is true in your jurisdiction, then to the extent permitted by law, Secure Blink limits its liability for any claims under those warranties or conditions to either supplying You the Platform again.

   You specifically acknowledge that Secure Blink shall not be liable for User content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with You.

6. Confidentiality

   To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Secure Blink, its associated corporations, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) Your use of and access to the Platform; (ii) Your violation of any term of these Terms of Use; (iii) Your violation of any third party right, including without limitation any copyright, property, or privacy right; (iv) any claim that Your user content caused damage to a third party; or (v) violation of any applicable laws. This defence and indemnification obligation will survive these Terms of Use and your use of the Platform.

7. User Conduct

   1. The User shall prohibit themselves from

      1. using Obscene or vulgar language;
      2. submitting content/information that is unlawful or otherwise objectionable. This includes, but is not limited to, content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
      3. submitting content that is intended to promote or incite violence;
      4. impersonating other people, particularly employees and representatives of Secure Blink or our affiliates;
      5. using the Secure Blink Platform for unauthorised mass-communication such as “spam” or “junk mail”
      6. violate these terms of use or any applicable laws, through any means by which Users identify themselves;

   2. The User shall

      1. make any or all submissions using the English language(s) as we may be unable to respond to enquiries submitted in any other languages;
      2. acknowledge that Secure Blink reserves the right to monitor any and all communications including but not limited to Chatbot, Email, Website Forms made to us or using our Platform.

8. Modifications and Amendments

   Secure Blink shall, in its sole discretion, modify or revise these Terms of Use and policies at any time, and you agree to be bound by such modifications or revisions. Your continued use of Secure Blink Platform post any modification of the Terms of Use shall be taken as your consent and acceptance to such modifications. Nothing in these Terms of Use shall be deemed to confer any third-party rights or benefits.

9. Termination

   We may terminate your account in case of any breach of these Terms of Use, or/and Privacy Policy. We may also terminate your account in case of breach of any conditions under the applicable laws, or any illegal act/misconduct of the User of the Platform.

10. Indemnity

    To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Secure Blink, its affiliated corporation(s), officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) Your use of and access to the Platform; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; (iv) any claim that your user content caused damage to a third party; or (v) violation of any applicable laws. This defence and indemnification obligation will survive these Terms of Use and Your use of the Platform

11. Force Majeure

    We shall not be liable for failure to perform, or the delay in performance of, any of its obligations if, and to the extent that, such failure or delay is caused by events substantially beyond the its control, including but not limited to acts of God, acts of the public enemy or governmental body in its sovereign or contractual capacity, war, terrorism, fire, strikes, epidemics, civil unrest or riots, and/or power outage.

12. Severability

    If for any reason whatsoever any provision of these Terms of Use is or becomes invalid, illegal or unenforceable or is declared by any court of competent jurisdiction or any other instrumentality to be invalid, illegal or unenforceable, the validity, legality or enforceability of the remaining provisions shall not be affected in any manner.

15. Governing Law and Jurisdiction

    The Terms of Use are governed by and constructed in accordance with the laws of India, without reference to conflict of laws principles and you irrevocably and unconditionally submit to the exclusive jurisdiction of the courts located in U.P.
